Terms of Service

Agreement

These terms govern your use of summitresultsagency.com and any services provided by Summit Results LLC. By using the site or purchasing a service, you agree to them. If you do not agree, do not use the site or the service.

What we provide

We provide two services. The Website service includes designing, building, hosting and maintaining a website for your business, including domain registration where needed. The AI Receptionist service includes configuring and operating an automated voice agent that answers your calls, qualifies callers, and books appointments.

Specific inclusions for each service are described on the relevant pages of this site and in the quote we send you. Anything outside that scope, such as a full redesign, a large batch of new pages, or a custom integration, is quoted separately as a flat price and only begins once you approve it.

Fees and payment

Services are billed monthly in advance. Your billing period begins on the date of your first payment and renews on the same date each month.

There is no setup fee. Prices are as listed on the pricing page at the time you sign up. If we change our prices, existing clients keep their current price for at least 60 days and we will tell you before any change takes effect.

Payments are processed by a third party payment processor. If a payment fails, we will contact you. If a payment remains unpaid for 14 days after it was due, we may suspend the service.

Cancellation

You can cancel at any time. There is no contract and no minimum term. Cancel before your next billing date and you will not be charged again.

We do not provide refunds for a partial month already paid. On cancellation, your service continues to the end of the period you paid for.

On cancellation of a Website service, your domain is yours and we will transfer it to you at no cost whenever you ask. The website itself is built, hosted and maintained by us as part of the service and does not transfer, though we will help you move to another provider in a reasonable way.

We may cancel or suspend service if you fail to pay, use the service unlawfully, or breach these terms.

Your responsibilities

You are responsible for the accuracy of the information you give us about your business, including services, pricing, hours and service area, since the website and the receptionist both rely on it.

You are responsible for making sure your use of the AI receptionist complies with the laws that apply to you, including call recording consent rules and telemarketing rules in your state. We will configure the service to help you comply, but the legal obligation sits with you as the business operating the phone line.

You confirm you have the right to use any content, logos, or images you give us for your website.

Service availability

We aim for continuous availability, but we do not guarantee uninterrupted service. Hosting providers, telephony networks and third party platforms occasionally fail, and scheduled maintenance is sometimes necessary. We will keep any planned downtime short and outside business hours where we can.

The AI receptionist is software. It will occasionally mishandle an unusual call. It is configured to escalate to you when it is unsure, and you can adjust those rules at any time. It is not a replacement for human judgement in emergencies.

No guarantee of results

We do not guarantee specific business outcomes, search engine rankings, lead volume, or revenue. Any figures or examples shown on this website are illustrative and are not a promise of results. Anyone in this industry who guarantees you a specific ranking or a specific number of leads is not being straight with you.

Intellectual property

The Summit Results name, logo and website content belong to us. Content you provide belongs to you, and you grant us the licence needed to use it in delivering your service.

Websites we build remain our property while you are a client, and are provided to you as part of the service.

Limitation of liability

To the extent permitted by law, our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose.

We are not liable for indirect or consequential losses, including lost profits or lost business, arising from use of the service or any interruption to it.

Changes to these terms

We may update these terms. If a change materially affects existing clients, we will give notice before it takes effect. Continuing to use the service after that means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Oregon, and any dispute will be handled in the courts of that state.
